Sehatify Terms & Conditions
Effective date: 26 October 2026
These Terms & Conditions (“Terms”) govern your use of the website sehatify.in, the Sehatify web application, mobile apps, analyzer connector and related services (the “Services”) provided by Sehatify Technologies Private Limited (“Sehatify”, “we”, “us”). By registering for, subscribing to or using the Services, you agree to these Terms and to our Privacy Policy. If you accept them for a lab or other organisation, you confirm you are authorised to bind it, and “you” then means that organisation.
1. Definitions
- “Lab” means the laboratory, diagnostic centre, clinic or other organisation that subscribes to the Services.
- “Users” means the people the Lab allows to use its account — owners, pathologists, technicians, front-desk staff, and referring doctors given access to the doctor portal.
- “Lab Data” means everything entered into, received by or generated in the Lab’s account, including patient details, test orders, analyzer results, reports and bills.
- “Plan” means the subscription the Lab chooses, with the price, bill quota and features stated on its order form, invoice or written offer.
2. Who can use Sehatify
The Services are for labs and healthcare businesses in India and their staff. You must be at least 18 and able to enter a binding contract under the Indian Contract Act, 1872. The Lab should ensure it holds the registrations, licences and other documents its business needs.
3. Your account
Give accurate details when you register and keep them current. Each User should have their own login; never share OTPs. The Lab is responsible for everything done through its account and for removing access when staff leave. Tell us at once at support@sehatify.in if you suspect unauthorised access.
4. Plans and fees
- The Lab receives the Services on its chosen Plan. Prices, bill quotas and one-time charges (such as analyzer interfacing) are those stated in the Lab’s order form, invoice or written offer.
- All prices exclude GST, which is added at the applicable rate.
- Fees are payable in advance for each billing cycle, monthly or annual.
- If a Lab uses more bills than its Plan includes, we may ask it to move to a higher Plan.
- We may change prices with prior notice. A change applies from the Lab’s next renewal, never in the middle of a paid period.
- Promotional offers apply only on the terms, dates and limits stated with them.
5. Payment and overdue accounts
- Pay through the payment link or method we provide. Payments are processed by our payment gateway; we do not store card details.
- We issue a GST tax invoice for every payment, sent to the Lab’s registered email or WhatsApp number.
- If payment is not received by the due date, we may suspend the account, including access to existing records, until payment is received. Access returns once the dues are paid.
- If dues remain unpaid, we may close the account after giving notice, as set out in section 19.
6. Cancellation and refunds
- A Lab may cancel at any time from within the platform. Cancellation stops the next renewal; the Lab keeps access until the end of the period already paid for.
- Fees already paid — subscription, onboarding, set-up or interfacing — are not refundable, including for an unused part of a billing period or an unused bill quota.
7. Lab Data and how we process it
The Lab owns its Lab Data. The Lab permits Sehatify to host, process and transmit Lab Data only to provide the Services, support the Lab, keep the Services secure, and as the law requires.
For patient data, the Lab is the Data Fiduciary and Sehatify is its Data Processor under the Digital Personal Data Protection Act, 2023. We will:
- process patient data only to provide the Services and on the Lab’s instructions, including the settings it chooses (such as WhatsApp delivery or sharing reports with doctors);
- keep it confidential and protect it with reasonable security safeguards;
- limit our staff’s access to what is needed to support the Lab, under confidentiality obligations;
- engage only service providers bound by comparable obligations, and remain responsible for them;
- tell the Lab without undue delay after we learn of a personal data breach affecting its data, and help it meet its own reporting duties;
- help the Lab respond to patients’ requests to access, correct or erase their data;
- delete or anonymise Lab Data once it is no longer needed, as set out in our Privacy Policy, unless the law requires us to keep it.
We may use aggregated, de-identified data that cannot identify any Lab, patient or person to run and improve the Services.
8. The Lab’s responsibilities
The Lab is responsible for:
- giving patients any notice and obtaining any consent the law requires before entering their data or messaging them — including consent to receive reports on WhatsApp, and consent from a parent or guardian where needed;
- the accuracy of its Lab Data, including checking results received from analyzers before a report is released;
- having every report signed or authorised by a signatory qualified under applicable law — Sehatify provides the tools but does not check qualifications;
- complying with the laws that govern its business, such as clinical establishment registration, medical record retention, bio-medical waste and tax laws.
Sehatify is software. It does not perform tests, interpret results, give medical advice or make diagnoses; clinical decisions stay with the Lab and the treating doctors.
9. Referral and partner records
Sehatify lets a Lab record its referring doctors and partners and the business they bring. These are business records for the Lab’s own use. Sehatify does not make or arrange payments to referrers. The Lab alone is responsible for ensuring that any arrangement with a doctor or other referrer complies with the law and with the rules on doctors’ professional conduct.
10. Your licence to use Sehatify
As long as you follow these Terms and pay your fees, we grant the Lab a limited, non-exclusive, non-transferable licence to use the Services for its own lab operations during its subscription. We keep all other rights.
11. Acceptable use
You must not:
- break any law or anyone’s rights, or upload unlawful or harmful content;
- try to access other Labs’ data, our systems or other accounts without permission, or test our security without our written consent;
- copy, reverse-engineer or decompile the software, except as the law expressly allows;
- introduce malware or deliberately overload the Services;
- resell or rent the Services, give access to anyone outside the Lab, or use them to build a competing product;
- use Sehatify to message people who have not agreed to receive messages, or to send spam.
We may suspend access to stop misuse (see section 19).
12. Analyzer connector and third-party services
- To connect analyzers, we install Sehatify’s connector on a computer at the Lab. The Lab must keep that computer powered, online and free of malware, and must not alter the connector. Interfacing depends on each analyzer’s output, so we cannot promise every model or firmware version is supported, and the Lab must check results after transfer.
- The Services rely on third parties such as WhatsApp (Meta), our payment gateway, cloud hosting and telecom networks. Their availability and rules — for example WhatsApp’s template approvals and messaging limits — are outside our control, and their own terms apply.
13. Communications from us
By registering, you agree that we may contact the Lab’s owner and Users by call, SMS, email or WhatsApp about the account, onboarding, support, billing and service changes. We send promotional messages only where permitted, and you can opt out at any time by writing to support@sehatify.in.
14. Availability and support
We aim to keep the Services available round the clock, apart from planned maintenance (which we try to schedule outside lab hours, with notice) and events outside our control. We do not promise uninterrupted or error-free service. Support is available by phone, WhatsApp and email during business hours.
15. Intellectual property
Sehatify owns the software, its design, the templates we create, and the Sehatify name and logo. The Lab keeps ownership of its own name, logo, letterhead content and Lab Data. If you send us suggestions or feedback, we may use them freely.
16. Disclaimers
The Services are provided “as is” and “as available”. To the extent the law allows, we give no implied warranties, including of fitness for a particular purpose. Sehatify is built for lab operations and record-keeping; it does not provide medical advice or diagnosis. Reference ranges and report formats we supply are starting defaults — the Lab must review and approve them before use.
17. Limitation of liability
To the extent the law allows:
- we are not liable for indirect, incidental, special or consequential losses, including lost profits, revenue, goodwill or data;
- our total liability for all claims relating to the Services is limited to the fees paid or payable by the Lab for the 3 months of Services before the event giving rise to the claim.
These limits do not apply where the law does not allow liability to be limited.
18. Indemnity
The Lab will compensate Sehatify for claims, losses and reasonable legal costs arising from: its Lab Data or a missing patient consent; its reports, clinical decisions or referral arrangements; or a breach of these Terms or of the law by the Lab or its Users.
19. Suspension and termination
We may suspend or end access, with notice where practical, if the Lab breaches these Terms or the law, if fees stay unpaid as described in section 5, if its use creates a security or legal risk, or if an authority requires it. The Lab may cancel as described in section 6.
When a subscription ends, we keep or delete Lab Data as described in our Privacy Policy. Sections 7, 15, 16, 17, 18 and 20 continue to apply after the subscription ends.
20. Governing law and disputes
These Terms are governed by the laws of India. Both sides will first try to settle any dispute through good-faith discussion for 30 days. If that fails, the courts at Noida (Gautam Buddh Nagar), Uttar Pradesh have exclusive jurisdiction.
21. Changes to these Terms
We may update these Terms. We will post the new version here with a new effective date and tell Labs about significant changes in advance through the app, email or WhatsApp. Continuing to use the Services after that date means you accept the new Terms; if you don’t, you may cancel before it.
22. General
- These Terms, our Privacy Policy and the Lab’s order form or invoice form the whole agreement. If they conflict, a signed order form prevails on its commercial terms.
- If any part of these Terms is unenforceable, the rest still applies. Not enforcing a right does not waive it.
- The Lab may not transfer its account or these Terms without our consent; we may transfer them to an affiliate or as part of a merger or acquisition.
- Sehatify is not liable for any failure or delay in providing the Services caused by events beyond its reasonable control, such as natural disasters, epidemics, war, civil unrest, strikes, government action, or internet, telecom or power failures.
- Notices to us go to support@sehatify.in; notices to the Lab go to its registered email or WhatsApp number.
